Beijing: Over-standard electric vehicles are on the road for a long time, and it is planned to punish 1000 yuan.
Electric bicycles that do not meet the requirements of the state may be detained and fined in 1000 yuan if they insist on driving on the road after the transition period expires. After three deliberations, this afternoon, the seventh meeting of the Standing Committee of the 15th Municipal People’s Congress will vote on the Regulations of Beijing Municipality on the Administration of Non-motor Vehicles (Draft).
After the transition period of the over-standard electric vehicle expires, the car can be detained first.
The reporter learned that if the previously purchased electric bicycle is not registered, it needs to apply to the traffic management department of the public security organ for registration within the prescribed time limit, and the driving license and number plate will be issued if it meets the requirements. For electric bicycles that exceed the standard, temporary signs will be issued and a three-year transition period will be given. Once the transition period expires, the over-standard electric bicycles will not be allowed to drive on the road.
In the previous second draft, there were no penalties for illegal acts such as not applying for temporary signs, not hanging temporary signs, forging or altering temporary signs during the transition period, and driving on the road after the transition period.
However, in the future, riding an over-standard electric bicycle may be detained and fined. The third review draft clearly stated that if an electric bicycle that does not meet the national standards fails to apply for a temporary logo within the prescribed time limit, and if it travels on the road after the transition period expires, it will be fined in 1000 yuan; If the registered electric bicycle does not hang a temporary sign on the road, it will be given a warning or fined in 20 yuan; Anyone who forges, alters or uses other temporary signs of electric bicycles to drive on the road shall confiscate the temporary signs and impose a fine on the driver in 1000 yuan. In addition, the traffic management department of the public security organ can detain the electric bicycle first and notify the driver to accept the treatment in time. After receiving the treatment, the traffic control department shall return the electric bicycle in time.
Bike-sharing enterprises must add confidentiality obligations.
There are many "cemeteries" in bike-sharing, hundreds of thousands of abandoned wilderness in bike-sharing are left unattended, and pedestrians have no way to go because of bike-sharing’s crowded roads … … In the future, in order to put bike-sharing into the market, enterprises must bear certain obligations while earning profits.
The reporter learned from the third review draft that, for example, according to the requirements of total regulation, enterprises are obliged to "put vehicles in accordance with the requirements of the traffic administrative department". The information submitted by the enterprise should include "the dynamic total amount of bicycles, the dynamic total amount of key areas, the credit punishment information of the lessee, and the parking position information of bicycles".
When encountering complaints and reports, enterprises should "establish a complaint handling mechanism to promptly accept and handle social complaints and reports on vehicle performance and parking order".
In the third draft, the obligation of enterprises to recycle "abandoned" vehicles and "clean up vehicles occupying roads, green spaces and other public places in time" was particularly increased. Among them, it is required that enterprises should allocate necessary management and maintenance personnel to be responsible for vehicle scheduling, parking order management, damaged and abandoned vehicles recycling, and timely clean up vehicles occupying roads, green spaces and other public places. In addition, if the relevant administrative departments take administrative measures against Internet bicycle rental according to law, they should inform the Internet bicycle rental business enterprises to accept the treatment in time. If it fails to accept the treatment within the time limit and fails to accept the treatment within 3 months after the announcement, the relevant administrative departments may dispose of it in accordance with the relevant provisions.
Moreover, a provision on confidentiality obligation has been added in the third review draft. Bike-sharing enterprises are required to "comply with the requirements of network security laws and regulations, and implement the systems of network security level protection, data security management and personal information protection".
Fire exits and blind roads are completely prohibited from stopping non-motor vehicles.
In the previous second draft, the no-stop area for non-motor vehicles was stipulated. However, some members of the Standing Committee have suggested that the expression of "a certain area" in the provisions is too vague and not operational, and needs to be further refined to facilitate public understanding and implementation.
To this end, it is clearly stated in the third draft that the areas where non-motor vehicles are prohibited include: no parking areas on sidewalks, fire exits and blind roads; Motor vehicle lanes and non-motor vehicle lanes that are not clearly defined as parking areas; The municipal traffic administrative department shall, jointly with the traffic administrative department of the municipal public security organ, delimit the no-parking areas in public places such as road intersections, railway crossings, entrances and exits of crowded places.
Bicycle rental was changed from "encouragement" to "implementation of total regulation"
In the previous second draft, it was proposed to encourage, guide and standardize enterprises to carry out bicycle rental services.
In this regard, some members of the Standing Committee believe that it is out of date to mention "encouragement" after the development of Internet rental bicycles at this stage. Accordingly, the expression of "encouragement" was deleted in the third draft, but it was only proposed to guide and standardize enterprises to carry out Internet bicycle rental services and not to develop electric bicycle rental.
At the same time, the third draft also added the content of "implementing total regulation" to the responsibilities of the municipal and district people’s governments. In the terms of responsibility of the traffic administrative department, four contents have been added, such as "formulating industry development policy norms and standards", "implementing electronic label management system", "supervising and managing information publicity system" and "implementing catalogue management for no parking areas".
Electric bicycle driving license and number plate are issued free of charge.
According to the opinions of CPPCC members, in order to further improve the registration rate of electric bicycles, "free registration" should be clearly stated in the regulations. Accordingly, the Legal Committee suggested that the contents of "free" issuance of electric bicycle driving license and number plate should be added to the application for registration.
To this end, it is clearly stated in the third draft that the traffic management department of the public security organ should inspect the electric bicycle that applies for registration. In the product catalogue and the application materials are complete and effective, the traffic administrative department of the public security organ shall register on the spot and issue the driving license and license plate of electric bicycle free of charge; Do not meet the requirements, shall not be registered, and inform the applicant in writing.
